THE P2M MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS, AND WITHOUT ANY REPRESENTATION, WARRANTY, GUARANTEE, OR CONDITION OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, ALL OF WHICH ARE HEREBY DISCLAIMED BY P2M AND ITS LICENSORS AND SUPPLIERS. ANY USE OF P2M MATERIALS IS AT YOUR SOLE RISK.
10. Limitation of Liability
IN NO EVENT SHALL P2M, ANY P2M AFFILIATES, OR ITS OR THEIR RESPECTIVE LICENSORS OR SUPPLIERS BE LIABLE FOR: (A) ANY CONSEQUENTIAL, INDIRECT, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES; (B) ANY LOSS OF PROFITS, BUSINESS, REVENUE, OR ANTICIPATED SAVINGS; (C) ANY LOSS OF OR DAMAGE TO DATA, NETWORKS, REPUTATION, OR GOODWILL; AND/OR (D) THE COST OF COVER OR PROCURING SUBSTITUTE GOODS OR SERVICES.
THE COMBINED AGGREGATE LIABILITY OF P2M AND ALL P2M AFFILIATES UNDER, OR OTHERWISE IN CONNECTION WITH, THIS AGREEMENT SHALL NOT EXCEED FIVE US DOLLARS (US$5).
11. Indemnification
You agree to defend, indemnify, and hold harmless P2M and P2M Affiliates, and their respective officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, judgments, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your breach of this Agreement or your use of P2M Materials other than as expressly authorized.
12. Miscellaneous
12.1 Entire Agreement. This Agreement represents the entire agreement between you and P2M with respect to the subject matter hereof, and supersedes and replaces any prior oral and/or written agreements between you and P2M with respect to such subject matter.
12.2 Governing Law. This Agreement shall be governed by, and construed in accordance with, the laws of the State of Delaware without regard to any conflicts of laws rules. You agree to submit to the personal and exclusive jurisdiction of the courts located in Tel Aviv-Jaffa for any disputes. Any cause of action must commence within one (1) year after the cause of action accrues.
12.3 Language; Electronic Contract. The language of this Agreement is English. You hereby irrevocably waive, to the maximum extent legally permitted, any Law requiring that the Agreement be localized or requiring an original (non-electronic) signature. When you click "SUBMIT", "I AGREE", or similar, you are submitting a legally binding electronic signature.
12.4 Email, Telephone and SMS Communication. By providing your email address, fax number, or phone number on the Website, you authorize us to contact you by telephone, fax, and email in connection with our Website, in response to inquiries you have requested, or to provide information or offers. You may opt out at any time by emailing with "UNSUBSCRIBE" or texting "STOP" as set forth in the communication.
12.5 Assignment. P2M may assign this Agreement without your consent. You may not assign this Agreement without P2M's express prior written consent.
12.6 Feedback. If you send us any suggestions or feedback, you agree that P2M exclusively owns all right, title, and interest in and to such feedback, and P2M may use, distribute, and commercially exploit it for any purpose without restriction or compensation.

Additional provisions governing severability, remedies, privacy, waiver, relationship of parties, notices, third party beneficiaries, export compliance, force majeure, California users, and subpoenas apply in full as set forth in P2M's complete Terms of Use. Dwolla
In order to use the payment functionality of our application, you must open a "Dwolla Account" provided by Dwolla, Inc. and you must accept the Dwolla Terms of Service and Privacy Policy. Any funds held in or transferred through your Dwolla Account are held or transferred by Dwolla's financial institution partners.
You must be at least 18 years old to create a Dwolla Account. You authorize us to collect and share with Dwolla your personal information including full name, email address, and financial information, and you are responsible for the accuracy and completeness of that data.
You understand that you will access and manage your Dwolla Account through our application, and Dwolla account notifications will be sent by us, not Dwolla. We will provide customer support for your Dwolla Account activity.
